These Terms of Service ("Terms") govern your use of handcraftedkeepsakegifts.com (the "Site") and purchases from Handcrafted Keepsake Gifts ("we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

1. Our Products

We offer handcrafted and made-to-order keepsakes, including personalized etched glassware, Pyrex baking dishes, tumblers, flameless candles, canvas totes, and similar items. Many products use names, monograms, dates, quotes, photos, artwork, or other details you provide.

Because many items are personalized or made to order, the order, proof, return, and refund terms below apply.

2. Eligibility

You must be at least 18 years old to place an order. By ordering, you represent that you have the legal right to use all text, names, photographs, and other content you submit.

3. Orders and Acceptance

Your order is an offer to buy. We may accept, decline, or cancel an order for a lawful reason, including incomplete or unusable personalization details, a pricing or inventory error, suspected fraud, or content that violates these Terms.

If we cannot fulfill an order as submitted, we will make a reasonable effort to contact you. If we cannot resolve the issue or cannot reach you, we may cancel the affected item and refund the amount paid for that item.

4. Customer Photos and Personalization

When you upload a photo or submit custom text, you give us a limited license to use that content only to:

• create proof, preview, or live mockup;
• produce, print, etch, or otherwise fulfill your order;
• communicate with you about the order; and
• retain the files as reasonably needed to complete production and resolve order issues.

You keep your rights in your photos and submitted content. We do not use customer photos for marketing, advertising, social media, or sample galleries unless you give separate written permission.

You are responsible for the quality, resolution, and crop of photos you submit, as well as the spelling, dates, names, and other text you enter. We will produce personalized items using the text, options, and photos you submit or approve. Please review all spelling, dates, names, and design choices carefully before placing your order or approving a proof.

We are not responsible for blurry, dark, cropped, or low-resolution photos, or for errors in content you entered, unless we make a production mistake against the details you submitted or approved.

5. Photo and Content Rules

You may not upload or request content that:

• you do not have the right to use;
• infringes on another person's copyright, trademark, privacy, publicity, or other rights;
• depicts a minor in a sexual or exploitative manner;
• is illegal, threatening, or intended to harass; or
• we reasonably determine we cannot or will not produce.

Memorial and family photos are welcome when you have the right to use them. If a photo includes another person, you represent that you have permission to use it on the product.

We may refuse or cancel an order that violates this section. If production has not started, we will refund the product price for the affected item.

6. Proofs, Previews, and Approval

If we provide digital proof, please review it carefully. Your approval authorizes us to produce that design.

For products that use an on-site personalization tool or live mockup, the preview is a guide. Small differences in color, scale, placement, or finish can occur during production. These differences are not a defect unless they are a clear production error.

7. Handmade Variation and Color

Our products are handcrafted or made to order. Slight variation in etching, print color, alignment, glass, coating, wax, or finish is normal. Colors shown on screens may differ from the finished product.

8. Pricing and Payment

Prices are shown on the Site and may change before you place an order. You agree to pay the total shown at checkout, including shipping charges and taxes where applicable.

Payments are processed through our payment providers. We do not store full payment card numbers in our systems.

9. Processing, Shipping, and Delivery

Orders of $150 or more shipped within the United States qualify for free shipping, unless a product page or promotion states otherwise.

For the products currently offered on the Site, personalized orders generally ship within 3 to 5 business days after the final digital proof is approved. If a proof is not required, processing begins after we receive the complete order and personalization details.

Shipping and delivery dates are estimates, not guarantees. During high-demand periods or when an unexpected issue affects production or delivery, a delay may occur. If we cannot ship within the stated timeframe, we will notify you and provide the options required by applicable law.

10. Returns, Exchanges, and Custom Items

Personalized and made-to-order items cannot be returned or exchanged due to a change of mind, dislike of the selected design, or an error in text or a photo supplied by the customer.

We will work with you to repair, replace, or refund an item when we make a production error, the item is defective, or it arrives damaged. Contact us promptly and include clear photos of the item and packaging when relevant.

Please contact us before returning any item. Unauthorized returns may not be eligible for a refund. Non-personalized items, if offered, may have different return terms stated on the product page or in our Return, Refunds and Exchanges Policy.

11. Intellectual Property

The Site, product photos, mockups, layouts, artwork, logos, and original designs are owned by us or our licensors. You may not copy, resell, reproduce, or use them except to shop and place an order.

Your submitted content is used only under the limited license described in Section 4. You do not receive rights in our templates, effects, wrap designs, or other store artwork simply by placing an order.

12. Third-Party Services

The Site is hosted by Shopify and may use third-party personalization, payment, shipping, and analytics providers. Those providers may have their own terms and privacy policies. We are not responsible for their systems except as required by law.

13. Disclaimer of Warranties

Except as required by applicable law, the Site and products are provided "as is" and "as available." We do not guarantee that the Site will always be uninterrupted or error-free, or that a preview will match the finished item in every detail.

14. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damage, including lost profits or emotional distress, arising from your use of the Site or a product.

Our total liability for a claim related to an order is limited to the amount paid for that order, except where the law does not allow that limitation.

15. Indemnity

You agree to indemnify and hold us harmless from claims arising from content you submitted, your violation of these Terms, or your infringement of another person's rights.

16. Privacy

Our Privacy Policy describes how we collect and use personal information, including photos submitted for personalized products.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use of the Site after an update means you accept the revised Terms.

18. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, except where another law requires otherwise.
